1. Eligibility

You must have full legal capacity to use the Services. Individuals under 18 should use the Services only with parental/guardian consent and guidance. Children under 13 must not use the Services.

2. Account Registration & Security

• You register with a nickname; email is optional. You must provide accurate information and keep it up to date.
• You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
• If you suspect unauthorized use, contact us promptly via in‑app “Settings → Support”.
• Registration requires your agreement to these Terms and to the Privacy Policy.

3. Acceptable Use Policy

• No illegal, infringing, obscene, hateful, harassing, malicious, or misleading content.
• No reverse engineering, vulnerability scanning, access‑control circumvention, automated scraping, or any activity that degrades service stability.
• No cheating (including exam misconduct) and no impersonation or infringement of third‑party rights.

4. Your Content & Intellectual Property

• You retain ownership of your content (e.g., uploaded documents, recordings, answers, comments).
• You grant us a worldwide, non‑exclusive, revocable, royalty‑free license to process such content solely as necessary to operate and improve the Services (e.g., generate personalized practice, evaluate pronunciation, display learning history, troubleshoot, and prevent abuse).
• You represent that you have all rights and permissions to upload and process such content and that it does not infringe others’ rights.
• Unless required by law or with your separate consent, we do not use personally identifiable data to train general‑purpose models for external use.

5. AI‑Specific Notices

• AI outputs may be inaccurate or incomplete and are for educational reference only; they do not constitute professional advice or guarantee exam outcomes.
• Pronunciation practice and speech reports process your recordings and derived audio features (e.g., pitch/f0, intensity, duration) to provide feedback and visualizations.
• Do not submit sensitive personal information (e.g., national ID, medical data, payment card details).

6. Fees & Trials

• If you enroll in paid plans or free trials (e.g., a 7‑day free trial), pricing, term, auto‑renewal, and refund rules are as displayed during checkout or on the relevant pages.
• Eligibility for discounts or trials may depend on region, promotions, or invite codes.

7. Suspension & Termination

We may restrict, suspend, or terminate some or all Services if you violate these Terms or for security/compliance reasons. You may request account deletion in Settings. We may retain logs or records required for legal compliance.

8. Disclaimer

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, non‑infringement, accuracy, and uninterrupted availability.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, punitive, special, or consequential damages arising from or related to your use of the Services. Our total aggregate liability will not exceed the fees you paid for the Services in the twelve (12) months preceding the event giving rise to liability (zero for free users).

10. Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, employees, and partners from third‑party claims arising from your content or your breach of these Terms, to the extent permitted by law, including reasonable attorneys’ fees.

11. Governing Law & Disputes

These Terms are governed by the laws of the People’s Republic of China (without regard to conflict‑of‑laws rules). Mandatory consumer‑protection rules in your jurisdiction prevail where applicable. Disputes will be resolved amicably where possible; otherwise, they may be brought before a competent court in your or our place of domicile.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in‑product or via other reasonable means. Continued use after the effective date constitutes acceptance of the updated Terms.
